    Hello,

    I would need to apply for transit visa to fly through UK. There is a UK consulate office in ATLANTA but not sure if they would give transit visa if I go in person there? Did anyone had any experience.

    In previous years, INS made a distinction between H-1B1 (Specialty Occupation) and H-1B2 (Fashion Model). These days they've dropped the distinction-- specialty occupation workers and fashion models get identical approval notices, indicating simply "H-1B." The H-1B1/H-1B2 distinction is gone, for all intents and purposes.

    H-1B visa status allows "dual intent," i.e. the intent to work temporarily in the U.S. and return home at the end of the H-1B period, plus the intent to apply for a green card (and not return home), should the opportunity become available. In other words, H-1B visa holders can pursue a green card with no adverse effects. Many of the other visa categories (e.g. F-1 student, B-1/B-2 visitor, and even E-2 treaty investor) allow only "non-immigrant intent." Having applied for a green card or abandoned one's residence abroad can be grounds for denial of one of these visas.

    I'm going to use EAD under 1099 as an independent contractor, My employer asked me to fill only w-9 form when i joined the company.

    My employer doesnt know whether i should fill I-9 form (employment verification eligibility) or not?

    Anybody have such experiences to share?

    Just FYI,our
    You can also extend the H1b...if your labor is filed 365 days prior to your H1b expiraton...
    You are looking atleast 21 months into future...there are so many things that can happen...
    140 rejection may not be an issue... but in case your worst fear comes true...you will be alright if it's rejected before feb 2008.
    Even then there are other ways around this problem...

    I am in MD and 140- is already approved, 485 filed on 12th July at Nebraska, where to file EAD and 131. ?
    If you have the receipt notice of I485, then find out the A# from it. Then apply for EAD and AP online( you need to fill A# at one place in both EAD and AP forms online). They can be applied together(online) but I don't know about applying by mail as I always applied for EAD and AP online.

    Hello All,

    I am currently in H1-B. My GC (EB2) is in progress sponsored by my company.
    The I-40 is approved but me and my wife�s I-485 is still pending.

    We both got our EADs, but we have never-ever used it. We just applied for it and kept the card.

    My wife was also on H1-B through her own employment. She got laid off so she is losing her H1-B. Now I want to apply for her H4 as my dependant. Since she already has an EAD, will applying for H4 nullify the EAD? As I said earlier that she has never used her EAD however she plans to use it when she gets a new job.

    Anybody in similar situation? Any remarks or suggestion would be greatly appreciated.

    I am currently in the US on L1 Individual visa - my current visa is expiring on the 28st of Feb. My employer filed for a fresh L1 Blanket Visa instead of doing an extension because I had RFE's on i94 extn. My visa interview is on the 23rd of Feb in Canada.

    Am I going to have any problems because I did not extend my visa and applied for a fresh one instead?

    Any delay due to PIMS? Do I need to check whether my petition number is in PIMS system?

    Any information provided is greatly appreciated.

    Thanks for the tip. I did figure out option "a" as the appropriate response since I do not have a prior EAD.

    Thanks for that link. It is good to know that there is a possibility that I-140 PP may come back in the near future, even if in phases.

    One comforting factor here is the extra $1000 is big money for no extra work which is very tempting to USCIS. So everyone knew they would bring it back as soon as the load became manageable, but the big question was when would the load become manageable.

    Now from the article, it looks like it may start happening very soon.

    I am trying to find health insurance for my spouse who is in H4 visa.

    Could you please let me know if I can buy the health insurance only for her? Is there some law which states H1B visa holder also needs to buy the health insurance along with the spouse?

    BTW, I am living in NJ.

    Thank you Anne for your reply.

    My wife did call the National Customer Service Center and opened a service request too. But we have not heard anything yet. We tried getting an infopass appointment but none is available in our area. We will try it again tomorrow. I am kind of surprised how this can happen because in the USCIS database, approval of derivative application requires a check on primary application approval first. This is what I have been told by another lawyer.

    Most likely, a clerical mistake of some kind was made. Your wife should call the National Customer Service Center to start the inquiry process.

    Dear All:

    Details: Indian, in H1-B status. Current visa stamp in passport expires in mid July but employer is applying for the extension.

    The situation: I want to quit my job late this summer and relocating to Asia. Before I leave this continent, I'd like to travel around South America and maybe even do some volunteer work. I'd love to travel for at least 1 and maybe even 2 months.

    Ideally, I would like to re-enter the US after this trip and collect my bags before flying to India.

    What are my options for re-entering?

    1) Get new H1-B stamp in passport before quitting the job (though this would be kind of a pain/expense). Quit the job, ask the company not to cancel the visa and re-enter the US after the trip on the new H1 stamp. I am guessing this is a somewhat risky option as I would technically be out of status, right?
    2) How hard would it be to switch to a tourist visa and get a new stamp in a country like say Argentina or Mexico?

    What do you think my best option is or am I out of luck?

    I have sent in my I-140 + 485.. SO i hope that they accept the 140s atleast... I hope they dont outright refuse the boxes... Atleast I haven't seen anythin about refusal on UPS website yet ..

    Just read that if you have sent one check for 1-140 & 485 then the whole package will be returned and you would have to refile your I140. If you have sent separate checks then they will just return the I485 part of your package.

    Hi, My Lawyer says that texas SWA gave him a figure of $ 105,000 annual salary as a prevailing wage for 5 years experience java,j2ee guy.
    .........

    $105,000 salary for 5 years exp with J2EE/Java sounds rights to me. People with 2/3 year experience are making around 80-85k.
