Hi All,
I had a question regarding the relationship between the number h1b transfers and green card process. I've heard some people say that if you have transferred H1b to many companies then the green card process will be delayed because USCIS needs to be convinced that you will be continuing with the same employer. Is this true or does it really not matter how many times you change employers it doesn't effect the green card process.
I have already transferred once. I am thinking of transferring one or possible two more times but am just worried about how this will effect the green card application process.

GC has nothing to do with H1b only issue is they will verify whether you were in status all the time.

The title is misleading - can be interpreted as "You are leaving your job and wife because you got an RFE and you want to know if there is any problem?"
I know, I saw it now and had a good laugh. Its just the job. I would have many more problems, besides GC, to consider if I were leaving her !!:)

I was in a similar situation. I emailed to this address info@phi.dflc.us from my company email. I didn't put anything else ( as per advice in some other forums). Received reply with the case number after a month. Meanwhile I received 45 days letter and so not worried much. As we all know this is a hit and miss. They may reply..but won't hurt to try.

Hi,
I am planning to file EB2 and port my EB3-I140 PD. My current position is System Analyst with EB3 job requirement. I can get a promotion but that doesnt qualify for EB2 job requirement. So I am planning to move to a different position, Research Associate which qualifies for EB2(it requires masters degree) with the same employer. Can I file EB2 with this position and port my EB3-I140 PD? Advice pls.

I am in a interesting situation. I have an approved EB2 I-140 but I recently applied for EB1-140 and I-485 concurrently and they are pending. Given that all PDs are now current, is it possible to convert my I-485 to the approved EB2 I-140. This will remove the uncertainty around approval of EB1 I-140. Any advice/experience is appreciated.
You can apply of AOS i.e I 485 only for one application . Since you already have applied for AOS on EB1 I highly doubt u can apply for AOS for EB2. Talk to your lawyer and find out

I don't think leave of absence nullify employer employee relationship. I checked this with my HR too when I was waiting for my EAD to be renewed. HR clearly told me that the only option was to terminate my employment in case my EAD was not renewed in time, and they would have opened the position and rehire me after receiving the physical EAD.

My H1B extension has been filed. Is it true that H1B extensions are rejected these days without proper reasons whatsoever?
And, if everything looks good, is a 3 year extension certain?

not necessarily true - for example if you get a B1 or B2 that's valid for 10 years - most likely it will exceed the validity of your passport. in that case when you renew your passport , in order to keepo using the Visa - you need to carry both the old and the new passports. H1B is the same, although for shorter duration (usually 3 years) so the issue does not come up as often. bbut of the visa is unexpired, and the passport is expired you would carry both passports to come in on the visa.
